RE: FN-FORUM IR35
date posted 17th April 2000 15:14
Thanks Ben.
It's this vagueness between self employment and employment that concerns me.
I know the IR have said that they'll look at each contract individually and
make their decision based on the actual way the work is being done. My gut
feeling is that the IR are only really after the lone agency contractors who
abuse the system by paying themselves a very low salary in proportion to
their dividends. It would cost a fortune to investigate all companies to
see if they fall under IR35 so they'll probably try to shortlist people
through their tax returns. If they try to say that anyone charging for
their services by the hour, using their own premises and their own
equipment, then IR35 would also apply to accountants, etc.
I've heard that the IR35 equivalent in Australia has just been scrapped so
let's hope this one will be dead before next April!
Regards,
Pete

Peter,
I've had a lot of information about this through my desk, and while the
wording of the contract is important, my understanding is that simply
changing the wording will NOT exempt people from IR35 changes - instead, it
is the nature of the relationship between the consultant and the end client
that IR will be looking at.
There is a LOT of confusion, and misinformation at the moment, and there is
no definitive 'answer', but there are a number of 'indicators' that IR look
at when establishing if a piece of work should be classed as 'Employment' or
'Consultancy'
Does that help?

Ben Hulme
