I had a client once who commissioned my company to design their =
site. I told them ( in person) that the site would be completed in about =
two weeks. I also said that I would require a deposit of 20%. They/he =
said that he wanted to pay in full when the site was done and that he =
didn't have the money now, would it be OK to pay in two weeks as it =
coincided with when he would have the money. I trusted him and we shook =
hands. To cut a long story short, I completed 95% of the site but was =
waiting for an 0800 number he was getting to add to his site, He stalled =
and stalled, telling me the cheque was in the post, his mother has it =
and is sending it, the bank has issued it, bla bla bla. Four months =
later I still handn't been paid. I asked nicely, I asked again and again =
and still excuses. I finally spoke to a lawyer who told me categorically =
that even if I didn't have a written contract, we had a verbal one and =
this would stand up in court. Also, that he could slap a county court =
judgement on them which would ruin his credit record for 7 years ( no =
loans etc, bad debt) When I threatened him with this he got really =
shirty but in the end he paid me in full. I realised that even if you =
like the client, get good feelings from them that I should of got a =
deposit or at least a written contract, not to prove anything but it =
would make the client feel as if they had to pay. I realised that I =
didn't NEED one after speaking with my lawyer, but it's a good idea. So, =
I would suggest you threaten him/them with a CCJ and see what comes =
back. My bet is that they will pay.
