If you own the rights to the images then I would suggest that you have
grounds to seek compensation (if you can prove that the images are actually
yours). If you are 100% certain then I would suggest seeking legal advice.
Get as much information as you can before doing anything (i.e. how many
issues there are of the brochure etc, how much is normally paid for such
images, if payment is fixed fee or royalty based etc).
There is a similar case (I believe it is still on-going) to do with the
image of Europe on the Euro notes. Some company claim that it is their
image and that it has been reproduced without their permission, they also
claim to be able to prove it is their image because they deliberately
flawed/marked the image.

I recently designed a ski brochure for a client which included some original
map-work. One of my client's direct competitors has just produced their
new brochure and they have scanned and used one of the maps without
permission.
They have not made any changes to the map -
it is an exact replication, scanned from the printed brochure.
What if anything, can we do about it? And, who takes the action, our client
or us?
