OT: Terms and conditions when sending out review products

date posted 8th January 2003 17:13

As part of my site promotion I've decided to start sending kit out to be
reviewed. However never doing this before I had made up some Terms and
Conditions to stop me getting ripped off and to make sure that stock doesn't
go missing.

I know that a lot of you guys here deal with contracts and terms and
conditions a lot more than me so any advice would be greatly apreciated. If
people feel that i have to pay for this sort of service then I do apologise
in advance and will contact a few people off list.

Cheers

1. By opening the package (other than to read this letter) you agree to the
following terms and conditions. These terms and conditions are negotiable
within reason.

2. All equipment sent remains the property of the supplier unless otherwise
stated.

3. You should advise the supplier when you have received and the item has
been collected and its whereabouts at all times. The reviewer is
responsible for the item(s) safe keeping at all times whilst with the
reviewer

4. If the item gets lost in transit other than supplied the supplier, the
reviewer will be liable for any costs for replacement and or retrieval of
said item(s)

5. All damages will be payable by the reviewer and or company reviewing
unless prior agreement via email is submitted as to warranty threatening
activities required by review. All damages must be paid within 30 days of
formal agreement of liability

6. If the item is damaged in transit when arriving to yourselves then you
will tell us within 24 hours.

7. If the item is DOA (dead on arrival) you must notify the supplier within
24 hours of the items being signed for.

8. Should the reviewer (you in this case) want to keep the item for an
extended period of time this is to be arranged with reasonable notice to the
supplier

9. Terms and conditions of reviewing equipment shall be non disclosable to
parties other than the supplier or the reviewer.

10. Published images used in any review remain the property of the parent
reviewing company. The supplier under all reasonable circumstances may ask
for promotional images from said review, in order to further the marketing
value of the item. These images may be used externally of the parent
reviewing company under the condition of ownership and reciprocal link.

11. Good will be returned as new and in original packaging. Good must be in
a state to be deemed still sellable. If the unit has been "clocked" or
"stress tested" then goods will be classed as no longer new but still must
retain all original packaging.

12. Terms and conditions are not to be altered without consent by both
parties
