My understanding is that copyright is implicit, whether it has a (c) logo
or copyright splashed over it or not. Turn it around the other way, if
something you created didn't have a copyright notice on it, and someone
used it without permission, you wouldn't think that's fair game.

Well I think you have to make a judgement call on whether the person
owning the copyright is big enough to have lots of money to employ big
scary lawyers.
Also, if you're using it in a positive light and it may promote the owner
then they shouldn't have any problem with it, so why not ask? If they
have a problem then it'll be likely they would have had a problem anyway
(perhaps moreso!) if you'd used it without permission.
If it's something they own that directly makes them income (say a photo
taken by a pro photographer), you can bet they might object. On the
other hand you may be using it in a non-commercial way? and they might
be quite happy for you to use it with the addition of their name stamped
in the corner of the image.
To cover yourself you should really write a letter and ask, but a quick
solution may be able to knock out an email to their PR dept. and ask?
(I am not a lawyer, just some observations and thoughts).
