Re: FN-FORUM: ITV & model pics - copyright probs?
date posted 24th June 2003 21:44
Hi,
OK...there's a world of possible pain here. Another hat I have is film
production, where this sort of thing is a big issue. However, I am not a
lawyer....
The image and logo are both copyright and that copyright will vest with the
person or organisation who paid for it (simply put). The ITV logo will
definitely be copyright and in addition to breaching their copyright you may
find yourself getting a 'cease and desist' order if they think you are in
any way implying a relationship between yourself and them.
The model image will have copyright that rests with the photographer and /
or the commissioning party. Also, the model may have signed a release that
allowed use of the image in a photo but not in other media. Basically, put
the images down on the ground and walk slowly away from them....when at a
safe distance run...;-)
Hope this helps!
Joe
