are these points to consider in the tenancy agreement I am not sure what
you mean Niels? Apart from the obvious that there could be problems in
the tennants not understanding they have to leave with the threat of the
house being burnt down!

I think these are your three options at the moment
1) sell with 'sitting tenants' ie, your buyers purchase knowing that they
have sitting tenants - fine if they are buying to let, but problematic if
they want to live there themselves.
2) Wait until you current tenancy agreement with your tenants expires and
ask them to leave (assuming you have a tenancy agreement). Then put the
property on the market.
3) Pay tenants to move out. If there is a long time to run on the tenancy
agreement and you want to sell earlier with vacant possession, the only way
to shift the tenants may be to offer them a payment by way of a 'sweetener'
Lastly, Citizens Advice will have details on current legislation and be able
to give you best advice - usually on the spot in person or over the phone.
