RE: FN-FORUM: Winning the Lottery - Advice

date posted 13th January 2006 00:46

Speak to your local Citizens Advice bureau. They're good with this kind =
of
thing.

I think your bro has a good case for 'keeping' the money. He didn't do
anything wrong and acted in good faith. However some employment =
contracts
have clauses saying that employees have a duty to return 'incorrect
payments'.

I'm no lawyer, but... The person who should have won the money, should =
take
legal action against the company for negligence in incorrectly issuing
his/her rightful winnings.

However, looking at the big picture, if your bro likes his job, he may =
just
back down and offer to pay it back in installments or something. He may =
be
vilified if he refuses to pay it back. But it all depends on the =
individuals
involved and the culture within the company.

In any case, he shouldn't do anything until he's spoken to the CAB.
