I'd blame cut & paste from the w3c ;-)
It was the HTML reference not the XHTML one in my defence.
But yes you are right. I shall go and find a large birch stick to beat

But is a block level element as well- I'm fairly sure you shouldn't
be running with unclosed paragraphs and crossed block level elements if
you're trying to be proper semantic...
